Behind every deposit compensation claim sits a body of tenancy deposit case law – decisions by the courts that have shaped exactly what landlords must do and what happens when they get it wrong. You don’t need to be a lawyer to benefit from understanding these cases. A few key principles, drawn from the leading […]

When people hear “solicitor”, they often picture a large bill landing before anything has even happened. That fear stops a lot of tenants from claiming compensation they’re owed. So let’s clear it up. A no win no fee tenancy deposit claim means exactly what it says: if your claim doesn’t succeed, you don’t pay us […]

One of the first questions tenants ask us is, “Surely it’s too late now?” In most cases, it isn’t. The deposit claim time limit is far more generous than people expect – generally six years – which means you may be able to claim long after you’ve moved out and forgotten all about it. If […]

You hand back the keys, and a few weeks later your landlord tells you they’re keeping a chunk of your deposit. A cleaning fee here, a “damage” charge there, a vague figure for the garden. Even landlords who protect the deposit on time often fail to provide complete, correct prescribed information within the deadline. And that failure can entitle […]

If your deposit was protected late – even by a single day – you may be entitled to compensation. Many tenants assume that as long as the deposit ended up in a scheme, everything was fine. That is not how the law works. The Housing Act 2004 sets a strict 30-day deadline, and missing it […]

The Government has confirmed that it has no plans to give the Housing Ombudsman enforcement powers. This means the Ombudsman can continue to investigate complaints and make recommendations, but it cannot fine landlords or force them to comply with its decisions. For tenants, this highlights an important point. An Ombudsman complaint isn’t always the best […]
