Our team can help you claim up to 3 times your tenancy deposit back

By law, landlords must place your deposit in one of the three government authorised Tenancy Deposit Schemes (TDS). This must be done within 30 days of receiving payment from you.

Many landlords fail to do this, and thus choose to ignore their legal obligation to you. Our specialist team of solicitors are here to protect your rights as a paying tenant and pursue compensation (of up to 3x the sum of your deposit) on your behalf.

How much compensation can I receive?

Compensation for your tenancy claim is likely to be between 1-3 times the value of your tenancy deposit for every breach of the tenancy agreement, as well as your original deposit payment.

Our tenancy deposit claim service is nationwide and is offered on a ‘No Win No Fee’ basis.

How can I check if my deposit is protected?

By law, your landlord is legally obligated to protect your deposit (within 30 days of receiving it) in one of these trusted government-backed schemes:

Deposit Protection Service (DPS)

The Dispute Service (TDS)

MyDeposits

All the above tenancy deposit schemes allow you to check online or you can contact them directly and inquire.

Do I have a Tenancy Deposit Claim?

If any of the following apply to you, you might be able to claim for financial compensation:

Deposit not protected

If you have checked with one of the three government-backed schemes and confirmed your deposit is not protected, you may have a claim.

Deposit not protected within 30 days

If your landlord didn’t protect your deposit in one of the above schemes within 30 days, you may have a tenancy deposit claim.

Landlord not returning my deposit

If your Landlord is refusing or unable to return your deposit, it may be because they didn’t protect it in one of the 3 schemes. You may therefore have grounds to claim.

No deposit information given

If you did not receive any correspondence, such as a letter or email, from one of the 3 government-backed deposit protection schemes, there is a possibility that your tenancy deposit was not properly protected, and you may have a claim.

Landlord made unfair deductions

If your Landlord made unreasonable deductions from your deposit, you may have grounds to claim compensation.

Protection scheme not extended

If your stay extended beyond the initial tenancy agreement and the tenancy deposit protection scheme was not extended accordingly, you may be able to claim.

How can I check if my deposit is protected?

By law, your landlord is legally obligated to protect your deposit (within 30 days of receiving it) in any of these UK government-backed schemes:

    Deposit Protection Service (DPS)

    MyDeposits

    The Dispute Service (TDS)

You can check all the above links to see if your deposit is protected or you can contact the schemes directly.

    How much could I claim?

The expert solicitors at Cook Legal could help you claim back up to 3x your original tenancy deposit.

My landlord hasn't protected my deposit. What can I do?

If your landlord hasn’t protected your deposit in a government-backed scheme, you may be able to claim compensation of up to 3x the value of your original deposit. Get in touch with Cook Legal today to see if we can help you claim.

How much does it cost to make a Tenancy Deposit claim?

There are no upfront fees to pay. In many cases, we are able to help clients on a ‘No Win, No Fee’ basis, so if your claim is unsuccessful, you do not have to pay anything. Our service charge will instead be a percentage deducted from the amount of compensation you are awarded.

How long will my claim take?

We have an excellent success rate for dispute claims, and most claims are concluded in 12-16 weeks.

How do I know if I can claim compensation? Is there a time limit?

If, over the past 6 years, you have experienced any of the following issues, you may be entitled to claim compensation:

    • You know your deposit was not protected.
    • You are not sure whether your deposit was protected.
    • You did not receive your deposit scheme protection certificate within 30 days of paying your deposit.
    • You did not receive your deposit back when your tenancy was completed.
What qualifies as unfair deductions from my deposit?

Landlords can only deduct for damages beyond normal wear and tear or unpaid rent. Charges for routine cleaning and minor scuffs could be considered unfair. If you’re facing unfair deductions, we can help you challenge them.

Do I need legal representation to make a claim?

You can pursue a deposit claim yourself, but having expert legal representation can strengthen your case and ensure you get the best possible outcome. Our team can guide you through the process.

What evidence do I need to support my claim?

Any tenancy agreement, photos of the property, an inventory, and communications with your landlord are key. The stronger your evidence, the better your chances. Unsure if your evidence is enough? We’ll assess it for you.

What should I do if my landlord won’t respond to my deposit dispute?

If your landlord isn’t engaging, don’t worry – we’ll step in. Our team can help you take the necessary steps to make sure your dispute is heard whether through the Courts or a Deposit Protection Scheme.

Can I still claim if I’ve already moved out of the property?

Absolutely. You can still pursue a claim after moving out as long as it is within 6 years from the day you paid your deposit. Don’t let time pass though – get in touch with us and we’ll make sure you don’t miss any deadlines.

Can I claim if I’m still living in the property?

Yes, you can. If your landlord hasn’t protected your deposit or you’re facing early deductions, you’re entitled to act even if your tenancy is ongoing. Reach out to us, and we’ll guide you through your options.

What are the consequences for landlords who fail to protect my deposit?

This is a serious breach of the law. Landlords can face penalties of up 3x the deposit amount if they fail to protect it. We’re here to help you claim what you’re owed.
